Libio’s 2nd bite at the Attorney Misfit Apple Tree – 2013
Libio represented 20 debtors in Federal Bankruptcy court. The bankruptcy petitions and schedules filed by Libio in many of the cases contained inaccuracies, leading to numerous amendments being filed. The amendments prepared by Libio often failed to correct the original inaccuracies, and created new ones which resulted in unreasonably delays in the cases themselves.
Libio’s court filings also contained misrepresentations regarding the compensation he received for his services. Making matters worse, Libio failed to appear at a number of court scheduled creditor’s meetings. His failure to appear resulted in the dismissal of most of his clients’ bankruptcy cases.
As a result of Libio’s gross misfeasance, the bankruptcy Trustee filed nine (9) Motions for Disgorgement of attorney fees paid to Libio. Eight of the motions were granted. Thereafter, Libio failed to provide timely proof of payment to the clients as ordered by the court.
The court then scheduled a sanctions hearing, but Libio failed to appear. However, several of his clients did appear and some of them informed the Court that they had never met Libio, and that their communications were with non-lawyer personnel at his office. Based upon that testimony, the Court issued Orders to Show Cause in all eight cases. Libio failed to respond to the Orders to Show Cause and also failed to appear at the Show Cause hearing.
As a consequence of her misconduct, the Patron Saints for Attorney Misfits sitting on the Florida Supreme Court punished Libio by gifting him with a complimentary 1-year suspension of his law license. In addition, Libio was ordered to reimburse his victims as follows:
