Attorney William Forman, Jr. of New Orleans; greedy loser
The state of Louisiana presented William H. Forman, Jr. with a law license in 1961.
The Office of Disciplinary Counsel found William guilty of the following misconduct.
In one matter, William represented Henrietta Vallery Reed in a child support matter. Henrietta’s husband was a member of the Marine Corps. While representing Ms. Reed, William obtained a judgment against her husband for past due child support. Payment of past due child support was sent to Williams’ office via U.S. Treasury checks made payable to the order of Henrietta S.V. Reed to the care of W.H. Forman.
William was not a payee on said checks. Louisiana law provides that when a court renders a judgment for past due child support, the court shall then award appropriate attorney fees. The reason for awarding attorney fees in child support matters is to assure that the full amount due is used for the benefit of the child.
In Ms. Reed’s case, the court awarded an attorney fee of $1,000. However, William claimed fees of $6,513. Over several months, William received seven checks from the military totaling $2,878, which he then deposited into his law firm’s account. Shortly thereafter, William issued a check to Ms. Reed for $1,099, and later issued two more checks totaling $314 for a grand total of $1,413.
Therefore, William retained $, 1465 in back child support payments as claimed fees that he absolutely knew he had no legal right to retain.
As a consequence of his misconduct, the Louisiana Supreme Court punished William by gifting him with a stayed 90-day suspension of his law license.
