The Delaware Supreme court found Callaway guilty of misconduct on at least four (4) occasions as set forth below.
 
Callaway’s 1st bite at the Attorney Misfit Apple Tree 

  1. Neglected a legal matter entrusted to him
  2. Engaged in a pattern of conduct involving deceit and misrepresentation
In one matter, Callaway represented a client in a lawsuit filed in the Justice of the Peace Court and obtained a judgment in his client’s favor. The opposing party appealed the judgment to the Superior Court. Callaway’s client instructed him to defend the appeal. Callaway failed to file the proper pleadings, and took no timely action on the case, so that the appeal was later dismissed to the damage of his client.
 
Thereafter, Callaway was not candid (lied) to his client about the status of her case, and also wasn’t candid (lied) to the disciplinary investigators.
 
As a consequence of his misconduct, apologists for Attorney Misfits sitting on the Delaware Supreme Court punished Callaway by gifting him with a complimentary reprimand.
 
Callaway’s 2nd bite at the Attorney Misfit Apple Tree 

  1. Failing to promptly deliver to third person funds he was lawfully entitled too
  2. Failed to bring a known conflict to the attention of a trial judge
  3. Failed to provide competent legal representation (moron)
  4. Failed to advise client of late filing of appeal notice
As a consequence of his misconduct, apologists for Attorney Misfits sitting on the Delaware Supreme Court punished Callaway by gifting him with a complimentary private admonition.
 
Callaway’s 3rd bite at the Attorney Misfit Apple Tree 

  1. Failed to act with reasonable diligence on client’s behalf (slacker)
  2. Failed to timely file a notice of appeal
As a consequence of his misconduct, apologists for Attorney Misfits sitting on the Delaware Supreme Court punished Callaway by gifting him with a second 2nd complimentary reprimand.
 
Callaway’s 4th -bite at the Attorney Misfit Apple Tree 

  1. Failed to abide by a client’s decision re: representation
  2. Failed to timely file a required notice of appeal
  3. Failed to act diligently in representing client (slacker)
In one matter, Callaway was assigned by the Public Defender Office to represent a client in a criminal matter. After trial, the client was found guilty and sentenced. The client directed Callaway at the time of a suppression of evidence hearing and after his trial that he wanted to appeal his conviction.
 
Callaway failed to draft and file an appeal on his client’s behalf. The client then prepared and filed his own notice of appeal, but it was rejected as being untimely filed.
 
As a consequence of his misconduct, apologists for Patron Saints sitting on the Delaware Supreme Court punished Callaway by gifting him with a two-year term of probation. In truth, the comedians sitting on the Supreme Court didn’t mete out any meaningful punishment to this four-time loser. 
 
As we speak (ca. November 2012), Callaway the Moronic Loser continues to be employed by the Office of Public Defender. It is painfully clear that no reputable law firm in the Sate of Delaware was about to offer this moron a good paying job.
