Attorney Michael Carper of Kearney, NE; unethical crook
The state of Nebraska presented Michael D. Carper with a law license in 1986.
Disciplinary Counsel of the Nebraska Supreme Court found Michael guilty of the following misconduct.
Michael entered into an employment agreement with his then roommate Jeffrey Grant to represent him regarding personal injuries he sustained in an auto accident. At the time, Grant was a passenger in a car driven by Shannon Sullivan. Allison Markham was responsible for the accident.
Six months later, Michael received a settlement check for $1,000 on behalf of Grant. He then signed Grant’s name to the check without Grant’s knowledge or consent.
Shortly thereafter, Michael told Grant that Ms. Markham’s insurer made a settlement offer of $7,000. Grant agreed to accept the offer believing the $7,000 was the gross settlement, not including the $1,000 previously received. On the same day, Markham’s insurer issued a check for $11,000 payable to Grant as an individual and Michael as attorney. Michael then signed Grant’s name to the check without his knowledge or consent.
Michael then issued a check to Grant for $4,470.73, which was $4,000 less then what he was lawfully entitled too. Subsequently, Grant contacted Markham’s insurer and discovered that the settlement amount it paid was $11,000 and not the $7,000 that Michael had falsely claimed.
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on Nebraska Supreme Court punished Michael by gifting him with a complimentary reprimand.
As we speak (ca. November 2012) Michael practices at 3915 Avenue N in Kearney, Nebraska.
