The state of Louisiana presented Donald G. Cave with a law license in 1969.
The Office of Disciplinary Counsel Donald guilty of the following misconduct
Donald thought it was acceptable to hire disbarred attorney Michael J. Matthews as a paralegal. Matthews’ disbarment was based on his conviction of five (5) counts of forgery and five (5) counts of theft, all of which involved client funds. He pled guilty to all ten (10) counts and received a rather complicated sentence. He was sentenced on two (2) counts of forgery and two (2) counts of theft to a total of ten (10) years in prison at hard labor. For the remaining three (3) counts of forgery and three (3) counts of theft, he was given suspended jail terms and was to be placed on supervised probation for a total period of fifteen (15) years.
Donald instructed Matthews to participate in several depositions in a wrongful death action Donald was handling. Matthews asked a number of questions of the witnesses. Subsequently, defense counsel objected when they discovered Matthews was a disbarred attorney. Based on that objection the trial court ordered that the depositions could not be used at the upcoming trial.
As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Louisiana Supreme Court punished Donald by gifting him with a complimentary reprimand.
