Judge Timothy Day of Greensburg, IN; ethical elf

 

The State of Indiana provided Timothy B. Day with a law license in 1972 after he graduated from Indiana University School of Law.

 

It should be noted that this isn’t Timmy’s First bite at the Judicial Misfit Tree. He previously received a complimentary admonishment for engaging in a variety of misconduct.

 

The Indiana Commission on Judicial Qualifications found Timmy guilty of engaging in the following misconduct. 

  • Engaged in improperly ex parte (one-sided) communications
  • Failed to take appropriate remedial measures upon receiving unauthorized ex parte communications
  • Failed to comply with the law (scofflaw)
  • Failed to act at all times in a manner that promotes confidence in the independence, integrity, and impartiality of the judiciary
  • Failed to avoid impropriety and the appearance of impropriety
  • Initiated, permitted, or considered ex parte communications or other communications made to the judge outside the presence of the parties or their lawyers concerning a pending matter
  • Failed to promptly notify the parties of unauthorized ex parte communications

As a direct consequence of his misconduct, the enablers for Judicial Misfits sitting on the Indiana Supreme Court punished Timmy by gifting him with a complimentary reprimand.

 

As we speak (ca. June 2024), Timmy continues to dispense his so-called version of jurisprudence as a Decatur Circuit Court judge in Greensburg, Indiana.
