In January 2012, the Board of Professional Responsibility found Sheryl guilty of the following misconduct.
Sheryl’s misconduct arose out of her representation of a criminal defendant who paid her $9,000 upfront to represent him.
was incompetent he discharged her and demanded a refund of fees she didn’t earn.
In her defense, Sheryl laughingly claimed that the $9,000 was a nonrefundable retainer. Under Tennessee Supreme Court Rules, if a retainer is to be nonrefundable, it has to be agreed to by the client in writing. Of course Sheryl the Comic never had such a written agreement.
As a consequence of her misconduct, the proponents for Attorney Misfits sitting on the Tennessee Board of Professional Responsibility punished Sheryl by gifting her with a complimentary censure.
As we speak (ca. May 2012) Sheryl practices law at 306 Gay Street in Nashville.
