The Grievance Committee of the North Carolina State Bar found Benny guilty of the following misconduct.

Court ruled motion to remove DA constituted vexatious litigation

Billed $100 an hour more than agreed to at outset of representation

Filed frivolous lawsuit against heirs of an estate

Misconduct involved multiple offenses

Engaged in conduct prejudicial to the administration of justice

Improperly engaged in ex parte (one-sided) communications with judge

Knowingly disobeyed the rules of a tribunal

Failed to cooperate with ethics investigators (Up yours, said Benny!)

Conduct led to limited court resources to be wasted

Repeatedly sanction by court for engaging in frivolous conduct

Victims of misconduct were vulnerable

Engaged in a pattern of misconduct

Refused to acknowledge wrongful nature of misconduct
As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Benny by gifting him with a complimentary 2-year suspension of his law license.
As we speak (ca. February 2016) Benny practices at 6208 Cress Road in Concord, North Carolina.
