Attorney Elmar Panopio of the Philippines; ethical troll

 

The Phillipine Supreme Court provided Elmar A. Panopio with a law license in 1967

 

The Committee on Bar Discipline found Lamberto guilty of engaging in the ollowing misconduct.

  • Made a sham claim that he was merely exercising his right to withhold to exercise retaining lien for unpaid fees
  • Failed to obtain client consent to the application of its property to the unpaid fees because a lawyer cannot unilaterally appropriate his client's property
  • There was no proof that the client consented to Elmar’s ' withholding of the titles to satisfy the unpaid legal fees.
  • Elmar improperly exercised its right to retain his clients s documents as a lien
  • Failed to hold in trust all moneys and properties of his client that may come into Elmar’s possession
  • Failed to account for all money or property collected or received for or from his client
  • Failed to observe candor, fairness and loyalty in all his dealings and transactions with his client
  • Engaged in a conflict of interest

As a direct consequence of his misconduct, the cheerleaders for Judicial Misfits sitting on the Philippines Supreme Court punished Elmar by gifting him with a complimentary reprimand.
