The state of North Carolina provided Gary B. Kivett with a law license in 1989.

 

The Grievance Committee of the North Carolina State Bar found Gary guilty of the following misconduct.

 

In one matter,Gary represented a female client in a criminal matter. During his representation, Gary made inappropriate comments and advances toward her, making it known to her that he wanted to have sex with her. Gary’s comments and advances included:

  • Telling her she was beautiful
  • Telling her she had a nice figure
  • Asking her to have dinner with him at his home and that if she did so she’d have fun
  • Trying to kiss her
  • Touching her waist in his attempts to kiss her

In a second matter, Gary represented a client regarding a speeding ticket. During the time he represented her he had sexual relations with her.

 

In a third matterGary represented a client regarding a Department of Social Services matter. While representing her, Gary had sexual relations with the woman at her home.

 

In a fourth matter,Gary consulted with a woman in his office about a divorce matter. During the consultation, Gary made inappropriate comments and advances toward her, making it known to her that he wanted to have sex with her. Gary’s comments and advances included the following.

  • Taking her hand and placing it over his genitals
  • Trying to convince her to perform oral sex on him
  • Kissing her

In a fifth matterGary represented a male client in a Department of Social Services matter. During the representation, the client was arrested for failure to pay child support. The client’s wife met with Gary regarding posting a bond on the support matter. Gary convinced her to travel to a tract of land he owned on which his client had agreed to clear some trees.

 

After arriving at the site, Gary made inappropriate comments and advances toward her, making it known that he wanted to have sex. Gary’s comments and advances included the following.

  • Complimented her on the appearance of her breasts and buttocks
  • Touched her breast and tried to kiss her

Subsequently, the client was charged with several felonies. The client’s wife consulted with Gary about the charges and he was ultimately appointed to represent the man. Subsequently, Gary repeatedly contacted the man’s wife. During those conversations and/or meetings, Gary resumed his advances towards her, which include the following:

  • Asked her to go away with him for the night to Cherokee
  • Tried to convince her to have sex with him
  • Masturbated in her presence at his home

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Gary by gifting him with a complimentary 4-year suspension of his law license.

 

As we speak (ca. June 2015) Gary practices in Spruce Pine, North Carolina.
