Attorney James Moldenhauer of Eau Claire, WI; serial offender

The state of Wisconsin presented James G. Moldenhauer with a law license in 1982 after he graduated from Hamline University Law School.

The Office of Lawyer Registration (OLR) found James guilty of the following misconduct.

As the personal representative of uncle’s estate, a client hired James to represent the estate in an informal probate proceeding. One year after the uncle’s will was admitted to probate; James drafted a letter to the register in probate enclosing the estate’s final account, receipts, and the personal representative’s statement to close.

14 months later, the client looked up the estate on the Wisconsin Circuit Court website and discovered the estate was still open. In an email to James the client asked why the case was shown as open; however, James failed to respond.

As one would suspect, this wasn’t James’ 1st bite at the Attorney Misfit Apple Tree. He previously was disciplined as follows:
  1. 1996 – Complimentary private reprimand
  2. 2006 – Complimentary public reprimand
  3. 2008 – Complimentary public reprimand
As a consequence of his most recent misconduct, the Patron Saints for Attorney Misfits sitting on the Wisconsin Supreme Court punished James by gifting him with a fourth (4th) complimentary reprimand. .

As we speak (ca. March 2013) James practices with the Moldenhauer Law Office at 3610 Oakwood Mall Drive in Eau Claire, Wisconsin.
