Attorney David Gerchak of Youngstown, OH; lying loser 

 

 The state of Ohio presented David John Gerchak with a law license in 1998 after he graduated from Thomas A. Cooley Law School.

 

Disciplinary Counsel of the Ohio Supreme Court found David guilty of the following misconduct.

 

In one matter, Bankruptcy Judge Kay Woods found Dave in contempt for failing to respond to show-cause orders in two separate cases and suspended his electronic-filing privileges for 60 days for purposes of filing new cases.

 

Less than a month later and despite Judge Woods’ order, Dave filed a new bankruptcy petition via use of the electronic-filing system. In a attempt to avoid being caught, Dave did not pay the filing fee along with the filing of the petition because if he did so electronically, he knew Judge Woods would discover such conduct.

 

Prior to filing the petition, the client paid $800 for filing fees. To avoid detection, Dave then filed an application with the court for his client to pay the filing fee in installments. Of course the application was patently false since Dave had already received the filing fee costs from his client.

 

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Ohio Supreme Court punished David by gifting him with a complimentary stayed 12-month suspension of his law license.

 

In truth, the comedians sitting on the Ohio Supreme Court didn’t mete out any meaningful punishment to Dave.

 

As we speak (ca. September 2013), David continues to practice in the Youngstown, Ohio area.
