Attorney Nicholas Gallo of Cleveland; ethical dwarf

The state of Ohio presented Nicholas Matthew Gallo with a law license in 2008 after he graduated from Cleveland State University Law School.

Disciplinary Counsel of the Ohio Supreme Court found Nicholas guilty of the following misconduct.
  1. Engaged in conduct prejudicial to the administration of justice
  2. Engaged in conduct adversely reflecting on his fitness to practice law
  3. Knowingly and recklessly made false statements concerning a judicial officer
At the time of his misconduct, Nicholas was an associate attorney at Stafford and Stafford Co. L.P.A. in Cleveland that primarily handled domestic-relations cases.

Nicholas represented Jeffery Rymers in a domestic case pending in Lake County Court of Common Pleas. Nicholas had never met Mr. Rymers, Mrs. Rymers or Mrs. Rymer’s attorney, and had never been to the Lake County Courthouse. Nicholas was, however, aware that Mrs. Rymers was in an ongoing relationship with Lake County Common Pleas Court Judge Eugene Lucci.

While Nicholas waited in the hall outside the domestic-relations courtroom, which is just across the hall from Judge Lucci’s judicial office, he saw a man repeatedly exit Judge Lucci’s office, look around the hall, and then re-enter the judge’s office. When Mr. Rymers appeared, Nicholas met him and walked down the hall to discuss the case with him. As they were talking, Mrs. Rymer’s attorney handed Nicholas a copy of Judge Lucci’s motion to intervene in the Rymers’ divorce proceeding.

Nicholas then proceeded to engage in an unwarranted attack on Judge Lucci by falsely claiming that he had engaged in improper ex parte communications with the Judge assigned to the Rymers divorce case. Nicholas defended his attack on Judge Lucci by laughingly claiming it was a case of mistaken identity. Put simply, Nicholas the Moron claimed he mistook Judge Lucci for someone else. Clearly, Nicholas missed his calling as a standup comedian.

As a consequent of his misconduct, the enablers for Attorney Misfits sitting on the Ohio Supreme Court punished Nicholas by gifting him with a complimentary reprimand.
