Attorney Alan McDonagh of Fargo; ethical misfit

 
The state of North Dakota presented Alan M. McDonagh with a law license in 1997 after he graduated from the University of North Dakota Law College.
 
The Disciplinary Board charged Alan with the following misconduct.
 
In one matter, Alan deposited client retainers into his law firm’s business account instead of a trust account. Alan then used about $30,000 of client funds to pay the operating expenses of his law firm.
 
Subsequently, one of Alan’s partners filed an affidavit stating that Alan admitted to using client funds to pay law firm operating expenses. In addition, Alan admitted forging another attorney’s signature and letterhead on title opinions.
 
Because Attorney Misfits in North Dakota are held to a much lower standard of conduct then everyone else, Alan was never criminally charged for forgery.
 
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the North Dakota Supreme Court punished Alan by gifting him with a complimentary interim suspension.
 
As we speak (ca. March 2013), Alan practices at 5613 47th Avenue South in Fargo, North Dakota.
