Attorney Thomas Ainsworth III of Charlotte; ethical leprechaun

The state of North Carolina presented Thomas Ainsworth III with a law license in 1981 after he graduated from Wake Forest University Law School.

The Grievance Committee of the North Carolina State Bar found Tommy guilty of the following misconduct.

While working as an attorney in a law firm, Tommy and his firm represented a woman involved in a personal injury case.

After Tommy’s association with the law firm ended, Tommy telephoned the client and told her that an associate at his former firm was less experienced then he was, and that he didn’t want her case and had turned it over to Tommy.

Tommy then told the client she needed to sign a release so that he could obtain her file and records from his prior law firm. The client signed the release believing that her attorney no longer wanted to represent her. However, the client later learned that Tommy was lying to her; she sent a letter stating she wished to retain her attorney.

After receipt of the client’s letter, Tommy repeatedly contacted her to change her mind, even telephoning her and members of her family while she was in the hospital.

The client then asked the State Bar to intervene so that Tommy would stop harassing her.

As a consequence of his misconduct the enablers for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Tommy by gifting him with a complimentary censure.

As we speak (ca. January 2014) Tommy practices with Downer Walters & Michener PA at 701 East Morehead Street in Charlotte, North Carolina.
