Attorney Nicholas Penkovsky of New York City; serial tax cheat

The state of New York presented Nicholas Alexander Penkovsky with a law license in 1994 after he graduated from the New York School of Law.

The Judicial Department Committee on Professional Standards found Nicky guilty of the following misconduct.

  • Neglected client’s copyright infringement matter
  • Failed to communicate with his client
  • Misled his client about status of the case
  • Disregarded his obligations to pay monetary judgements owed for court reporting and appellate printing services, law student loans and his landlord for unpaid office rent
  • Engaged in conduct adversely reflecting on fitness to practice law
  • Deliberately caused his adversary to waste time and resources in opposing a dismissal motion
  • Failed to file tax returns or pay taxes for seven (7) consecutive years
  • Misled ethics investigators to believe that filing extensions granted by the IRS remained in effect

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Professional Standards Committee punished Nicky by gifting him with a complimentary 3-month suspension of his law license.

As we speak (ca. November 2019), Nicky practices with The Penkovsky Law Group PC at 43 West 43rd Street in New York, New York.
