Attorney Stewart McGough of Syracuse, NY; ethical gnome

 

The state of New York provided Stewart Meagher McGough with a law license in 1980 after he graduated from Cornell University Law School. 

 

The Appellate Disciplinary Board found Stu guilty of the following misconduct

  • Engaged in an egregious conflict of interest
  • Provided dual representation re: drafting revised estate planning documents
  • Attempted to have two clients sign draft trust amendments and estate documents despite a court order to the contrary
  • Represented the elderly wife and husband in drafting revised estate planning documents
  • Failed to advise both clients to seek advice from independent counsel about the proposed changes and to obtain a written conflict waiver

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Appellate Disciplinary Board punished Stu by gifting him with a complimentary reprimand.
