The state of Massachusetts presented John Michael Gerard with a law license in 1995.
 
The Massachusetts Board of Bar Overseers found John guilty of the following misconduct.
 
For three years, John maintained an office/client trust account and personal accounts. For at least two years, the IRS had a lien against John’s personal accounts.
 
To avoid the lien, John deposited personal funds into his office/client trust account. John also withdrew funds from the office/client trust account via cash withdrawals and checks payable to cash in order to pay his personal expenses.
 
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Bar Overseers punished John by gifting him with a complimentary reprimand.
 
In truth, Johnny engaged in a scheme for several years to defraud the IRS. To suggest that this type of ongoing fraud did not demand that John be disbarred is absurd. This type of non-punishment is just another reason why most folks in Massachusetts have absolutely no confidence in the so-called attorney discipline system.
