Attorney Vincent Garcia of Wichita, KS; ethically indigent

 
The state of Kansas presented Vincent J. Garcia with a law license in 1999.
 
The Kansas Disciplinary Board found Stephen guilty of the following misconduct.
 
Attorney Sean Shores filed a divorce action on his client’s behalf. Vincent represented the wife and the couple had one minor child. Temporary custody orders provided that Shores’ client would have primary residential custody and Vincent’s client would have parenting time every other weekend. However, the temporary orders didn’t specify the date when the parenting time would begin.
 
On October 22, Vincent called Shores to ask whether parenting time could begin that weekend. Shores told him he’d check with his client and let Vincent know. Shores couldn’t reach the husband and left town for the weekend without informing Vincent of the status of the parenting time matter. Later that evening, Vincent called Shore’s client without his permission and left a voice mail message. The message said the husband was supposed to have taken the child to the wife and because he hadn’t done so, he was in contempt of court. The message told Shore’s client to call Vincent back.
 
The client’s attempts to contact Shores were unsuccessful. He then called Vincent. Vincent knowingly lied to the husband when he told him he was in contempt of court and that if he didn’t deliver the child to the wife he would file a citation for contempt with the trial court.
 
During his sham call to the husband, Vincent found it acceptable to use profanity, threatened to have him arrested, and shouted at him during the phone conversation.
 
Vincent then had the chutzpah to actually file a contempt motion with the trial court against the husband; however, the trial judge tossed because the husband hadn’t violated any parental visitation order.
 
This wasn’t Vincent’s 1st bite at the Attorney Misfit Apple Tree. He was previously disciplined for engaging in a variety of misconduct
 
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Kansas Supreme Court punished Stephen by gifting him with a complimentary censure.
 
As we speak (ca. October 2012) Vincent practices with the Garcia Law Office at 1851 North Broadway in Wichita, Kansas.
