In the early 1990s, Andrew became acquainted with Fernando Tonelli, an Italian national, while Fernando was vacationing in Miami. Later on, Tonelli moved to Miami and struck up a friendship with Andrew. Over the next several years, the two became close friends.

In 1995, Tonelli became involved in trafficking Ecstasy from Europe to the U.S., a fact that Andrew was fully aware of. In late 1996, Tonelli became aware that Andrew was struggling to earn a living practicing law. With that knowledge, Tonelli told Andrew he could make some extra money by aiding him in his criminal activities. Andrew agreed and made a trip to Europe on Tonelli’s behalf to deliver money and purchase Ecstasy.

A year later, Andrew again assisted Tonelli by making of delivery of Ecstasy to a buyer in New York City. Andrew was scheduled to meet the buyer at a hotel near the airport. Once inside the hotel room, the buyer pointed a handgun at Andrew’s had, tied him up, and robbed him of the Ecstasy. Tonelli didn’t believe Andrew about the theft and threatened him to provide the money “or else.” Andrew asked his father for the money to pay back Tonelli for the loss of the Ecstasy.

In late 2005, Andrew was contacted by two DBA agents who told him that he was the last co-conspirator they were going after in a ten year investigation. The agents also told Andrew that if he didn’t cooperate, they would charge his 78 year-old father (a retired surgeon) with conspiracy as well, claiming his father traveled to Europe to pay Andrew’s trafficking deal. Subsequently, Andrew cooperated fully and within several months pleaded guilty to the felony charges lodged against him. Andrew was sentenced to 4 months in prison and 4 months of house arrest.
