Attorney James Tyler III of Georgetown, DE; liar, repeat offender

The state of Delaware presented James B. Tyler III with a law license in 1974 after he graduated from the University of Virginia Law School.

The Delaware Supreme court found James guilty of the following misconduct.
  1. Engaged in conduct prejudicial to the administration of justice
  2. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  3. Issued checks on account with insufficient funds (rubber)
  4. Engaged in a pattern of misconduct
James found it acceptable to file false Certificates of Compliance with the Delaware Supreme Court for three (3) consecutive years wherein he falsely certified that his books and records were in compliance with the specific Rules of the Court.

In addition, James failed to prepare reconciliations of his accounting records and client balances on a monthly basis. On four occasions, checks were issued resulting in overdrafts (rubber) in James’ operating account.

As one would suspect, this wasn’t James’ 1st bite at the Attorney Misfit Apple Tree. The comedians sitting on the Delaware Supreme Court previously punished James as follows:
  • 1995 – Private admonition for failing to keep client informed of legal matter
  • 1999 – Private admonition for failing to act with due diligence (slacker), and failing to keep client informed about status of legal matter
As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Delaware Supreme Court punished James by gifting him with a complimentary reprimand.

As we speak (ca. May 2013) James practices at 8 West Market Street in Georgetown, Delaware.
