Attorney Oscar Stilley of Ft. Smith, AR; ethical leprechaun
The Arkansas Supreme Court Committee on Professional Conduct found John guilty of the following misconduct.
Oscar’s misconduct involved his unsuccessful pursuit of a frivolous lawsuit on behalf of a client that subsequently led to Oscar and the client being sued for malicious prosecution. After the malicious prosecution lawsuit was filed, Oscar not only represented himself, but he represented his client who was his co-defendant.
When the plaintiff’s offered to settle for $30,000, Oscar never advised his client of the offer. In addition, Oscar never advised his client of an indemnity agreement that made Oscar 100% liable for any countersuits brought against him and a client.
Eventually the malicious prosecution case went to trial and the jury returned a $200,000 verdict against Oscar and his client. After the client employed separate counsel, the trial court enforced the indemnity agreement thereby making Oscar the only person liable for the $200,000 judgment.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Arkansas Supreme Court Committee on Professional Conduct punished Oscar by gifting him with a complimentary 30-day suspension of his law license.
As we speak (ca. July 2012) Oscar continues to practice law at 7103 Racetrack Loop in Fort Smith, Arkansas.
