Attorney Joseph Herbert of Mesa, AZ; repeat offender

 

The state of Arizona presented Joseph A. Herbert with a law license in 1989 after he graduated from Creighton University Law School.

 

The Arizona State Bar found Joey guilty of the following misconduct.

 

Joey’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to turn over client files
  • Prejudiced client
  • Failed to act with due diligence (slacker)
  • Failed to protect client interests upon termination
  • Withdrew funds from client’s account w/o client consent/knowledge
  • Failed to provide client opportunity to challenge fee claims

As a consequence of his misconduct, the cheerleaders of Attorney Misfits sitting on the Arizona Supreme Court punished Joey by gifting him with a complimentary 30-day suspension of his law license.

 

Joey’s 2nd bite at the Attorney Misfit Apple Tree

  • Engaged in conflict of interest
  • Negotiated with client to lease client’s home
  • Filed forcible detainer action (removal from home) against former client
  • Trial court ruled forcible detainer action to be w/o justification
  • Trial court ordered Joey to pay former client’s legal fees for defending against his sham forcible detainer action

As a consequence of his misconduct, the cheerleaders of Attorney Misfits sitting on the Arizona Supreme Court punished Joey by gifting him with a complimentary censure.

 

As we speak (ca. April 2016), Joey practices at 1148 West Baseline Road in Mesa, Arizona.
