Attorney Florence Bruemmer of Phoenix; ethical gremlin

 

The state of Arizona presented Florence Bruemmer with a law license in 1999 after she graduated from Loyola University School of Law in Chicago.

 

The Arizona State Bar found Florence guilty of engaging in the following misconduct. 

 

In one matter, Florence’s client contracted to buy a home for his ex-wife, pay the mortgage on the home, and make certain repairs. Subsequently, Florence’s client stopped paying the mortgage and intended to let the home go into foreclosure. Florence knew of her client’s action and intention. The ex-wife sued Florence’s client for breach of contract based on the client’s failure to make the repairs. The court held an evidentiary hearing at which neither Florence nor her client disclosed the cessation of mortgage payments.

 

After the hearing, the court entered an order awarding damages to the ex-wife based on the court’s assumption that Florence’s client had been paying the mortgage. After the hearing, the ex-wife learned of the mortgage default and filed a motion for a new trial. The court granted the motion because the mortgage default impacted the damages calculation.

 

As a direct consequence of her misconduct, the enablers for Attorney Misfits sitting on the Arizona Supreme Court punished Florence by gifting her with a complimentary reprimand and assessed costs of the disciplinary proceeding in the amount of $1,207.56.
