Judge Elaine Rushing of Santa Rosa, CA; lush, ethical gremlin, certified moron Unfortunately, Judge Elaine Rushing is a sitting judge on the Superior Court in Sonoma County (Santa Rose), California.
 In June 2006, Judge Elaine Rushing received a complimentary public censure from the enablers/apologists sitting on the California Judicial Commission. The Commission found Judge Elaine Rushing guilty of the following misconduct.
On June 21, 2005, while driving drunk, Judge Elaine Rushing smashed into a stone fence belonging to a private home in Santa Rosa. She left the scene of the accident and continued for another two miles before her Porsche went into a ditch. Her blood alcohol level at the time was 0.20, which was almost three times the legal limit.
When a passerby stopped to offer help, Judge Rushing told her to leave. When a second passerby stopped and offered to call for help (the cops) she said “were fine” [she was alone], and then told her to not call anyone.
Judge Elaine Rushing lies to Highway Patrol Officers
 When Patrol Officers arrived, Judge Rushing knowingly lied by telling them by spewing forth the following falsehoods:
Judge Rushing’s fanciful and fabricated statements to the Highway Patrol Officers may have been believable if her drunken escapade took place in Roswell, New Mexico, right?
Judge Elaine rushing demands special treatment
 Elaine told the officers she drank “two bottles” of alcohol. She then corrected herself by saying, “two glasses.” Obviously, she was right the first time! When the police knew her story didn’t add up and asked her to take a sobriety test, Elaine said, “But I’m a judge,” and I told you I wasn’t the driver.”
Judge Rushing repeated that the officer should not be arresting a judge and that her husband, Conrad Rushing, was an appellate court justice as she was hauled away in handcuffs.
I see, Elaine! Because you’re a trial court level judge and your husband is an appellate judge, you’re entitled to treat the law with total disdain and contempt, right? And Highway Patrol Officers are required to treat you differently than us, right Elaine? My bad Elaine!!!
Judge Rushing admits to violating law
Judge Rushing told Officer Holeman that in her court she goes against court policies for CHP (California Highway Patrol) and other officers, and that he should extend that courtesy [violate the law] to her. This is a rather astonishing admission, right? What we have is a judge admitting that it is her custom to knowingly “violate court policies” [the law] to provide assistance to law enforcement.
This can only mean that Judge Elaine Rushing has repeatedly violated the constitutional rights of defendants appearing in her court. Why didn’t the Judicial Commission or California Supreme Court investigate this serious matter? My bad!!!
Judicial Commission Findings
The commission found Ellie was guilty of engaging in a course of dishonest conduct (lying to the cops) in an attempt to avoid being arrested. The enablers then ruled:
Because she wasn’t acting in a judicial capacity when demanding preferential treatment, she committed prejudicial, rather than will misconduct. Bullshit!!
Her conduct was “reprehensible” in demanding preferred treatment [Oh, really?]
There was no on-bench misconduct and there was no direct adverse effect on the administration of justice per se [What about obstruction of justice?]
She said she had modified her behavior [has her husband drive when she’s drunk and he’s not] and promised not to re-offend [So did Jeffrey Dahmer!!!]
Judge Elaine Rushing’s so-called punishment
Judge Rushing was sentenced to a ten-day work release program, a 45-hour alcohol counseling program, a $1,890 fine, and three years of informal probation for her DUI conviction.
In addition, Judge Rushing was gifted with a complimentary public censure.
Dawg’s commentary
From the time Judge Rushing smashed into a stone fence while stoned, she embarked on a scheme of lies and deceit to try and escape criminal liability for her conduct. When her fabrications didn’t work, she decided to use her judicial position and that of her husband in demanding that she receive special treatment.
Allowing this serial liar and deceiver to remain on the bench is nothing more than a slap in the face of every voter and taxpayer in Santa Rosa. I don’t believe for a minute (and I suspect you don’t) that this was the first time that Judge Rushing drove under the influence. It is likely that her appellate judge husband was well aware of Ellie’s conduct in driving while inebriated.
It would be difficult to believe that you could live with a lush and not know it. Her husband had a sworn duty to report her criminal conduct to the proper authorities, which he obviously never did. His inaction in and of itself is a violation of the Code of Professional Responsibility and only proves judges are held to a “lower standard of conduct” then we are.
