Attorney Brian Nelson of Des Moines; serial offender

 

The state of Iowa provided Brian Jesse Nelson with a law license in 1999 after he graduated from the University of Iowa Law School.

 

The Iowa State Bar Association found Brian guilty of the following misconduct.

 

Brian’s 1st bite at the Attorney Misfit Apple Tree

 

  • Failed to advise client of dismissal of lawsuit
  • Neglected legal matter entrusted to him
  • Failed to communicate with clients
  • Failed to comply with opposing party’s discovery requests

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Iowa Supreme Court punished Brian by gifting him with a complimentary reprimand.

 

Brian’s 2nd bite at the Attorney Misfit Apple Tree

 

  • Neglected legal matter entrusted to him
  • Negligence led to client’s unnecessary arrest
  • Failed to properly advise student client

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Iowa Supreme Court punished Brian by gifting him with a complimentary reprimand.

 

Brian’s 3rd bite at the Attorney Misfit Apple Tree

 

  • Failed to appear for court ordered scheduling conference
  • Neglected legal matter entrusted to him
  • Failed to provide timely accounting to client

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Iowa Supreme Court punished Brian by gifting him with a complimentary reprimand, which was his third.

 

Brian’s 4th bite at the Attorney Misfit Apple Tree

 

  • Failed to cooperate with ethics investigators (Up yours, said Brian!)
  • Failed to properly handle client funds
  • Engaged in conduct prejudicial to the administration of justice
  • Failed to communicate with clients
  • Failed to promptly return unearned fees
  • Knowingly disobeyed an obligations under the rules of a tribunal
  • Failed to properly terminate client representation
  • Failed to safeguard client property
  • Failed to communicate with client regarding fees
  • Failed to keep client informed of status of legal matter
  • Failed to act with due diligence (slacker)

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Iowa Supreme Court punished Brian by gifting him with a complimentary 1-year suspension of his law license.

 

As we speak (ca. November 2014), Brian practices at 300 Walnut Street in Des Moines, Iowa.
