Judge William Carter of Albany, NY; Il Duce Wannabee, ethical gremlin

 
Unfortunately, Judge William Carter is a sitting judge in Albany, New York. In 2006, the New York Judicial Commission found Judge William Carter guilty of the following misconduct. FYI: Il Duce is none other than Benito Mussolini, degenerate dictator of Italy and close associate of Adloph Hitler during World War II.
Threatening Talib Alsaifullah
In Oct. 2004, Talib Alsaifullah was brought before Judge William Carter for arraignment on a loitering charge, which led to him setting bail at $500. Because Talib was charged with assault in Aug. with bail set at $5,000, he remanded him to jail.
 
In November 2004, Judge Carter ordered Talib to appear before him about a letter expressing concerns about the assault charges and the representation provided to Talib by the public defender.
 
At the hearing, Judge Carter allowed Talib to argue his position. After Talib became agitated and said he didn’t want to participate because he claimed it was illegal, Judge William Carter became angry and, without adjourning the hearing, abruptly removed his glasses and robe, got up from the bench, and proceeded rapidly towards Talib, in a manner indicating his purpose was to confront him. One witness in the courtroom heard Judge Carter say to Talib, “You want a piece of me?”
 
As Judge Carter left the bench, a policeman quickly removed Talib from the courtroom while another policeman physically blocked Bill’s path by placing himself in front of Talib. However, Judge William Carter tried to go around the officer by stepping to one side and then the other, but the officer continued to block him by sidestepping along with him each time.
Charles Willis matter
In March 2005, Willis came before Judge Carter to be arraigned on several criminal charges. The DA recommended that bail be set at $25,000; however, Judge Carter released Willis on his own recognizance even though he was required to remand him without bail, since Willis had two prior felony convictions.
 
After the arresting officer told Judge Carter that Willis had flipped him off in the courtroom, Carter said he wouldn’t do anything because he didn’t witness the act. When the officer expressed dissatisfaction, Judge Carter said, “If you are so upset about it, why don’t you just thump the shit out of him outside the courthouse, because I’m not going to do anything about it.”
 
At the time of this incident, Judge William Carter was fully aware that he was under investigation for his misconduct involving the Talib Alsaifullah matter.
Judge Carter’s 1st bite at the Judicial Misfit tree
 
In February 2004, Judge William Carter received a complimentary “secret” caution from the enablers/apologists on the New York Judicial Commission.
 
In this matter, Judge Carter was found guilty of ignoring New York law on issuing bail determinations (aka, due process). Of course Judge Carter’s conduct in the Charles Willis matter clearly demonstrates that after receipt of this complimentary “secret” caution that he no intention of conducting himself in accordance with the oath of office he took when he ascended to the bench.
 
Judge Carter’s punishment for 2nd bite at the Judicial Misfit tree
 
In this instance, the apologists on the New York Judicial Commission gifted Judge William Carter with a complimentary censure.
 
To be fair, two members of the Commission, Judge Terry Jane Ruderman and Thomas A. Klonick dissented, demanding that Judge Carter be removed from the bench. In their dissent, they said:
  • "Judge Carter’s misconduct is egregious and demonstrates a total lack of self-control and necessary judicial temperament; thus rending him unfit to serve as a judge."
  • "It is shocking for a judge, in open court, to offer himself as a willing combatant when a judge’s role is to maintain a neutral atmosphere in the courtroom."
  • "Judge Carter’s belligerent manifestation of a readiness to resolve a courtroom disagreement in such an aggressive, street-like manner flies in the face of the very reason litigants in our society proceed to court, i.e., for an orderly and civilized resolution of disputes on the merits."
Kudos to Judge Ruderman and Mr. Klonick for telling it like it is and shame on the two judges and five attorneys that acted as certified enablers and apologists on behalf of Judge William Carter.
