Attorney Arlene Powers of South Easton, MA; ethical misfit

The state of Massachusetts presented Arlene J. Powers with a law license in 1991.

The Board of Bar Overseers found Arlene guilty of the following misconduct.

In June 2013, Arlene was suspended from practicing law by the US Patent and Trademark Office (USPTO) for two years.

In May 2003, Arlene filed a patent application with the USPTO. The USPTO sent Arlene a notice of missing parts and, receiving no response to the notice, issued a notice of abandonment in September 2004.

In July 2009, Arlene filed a petition to revive the patent application, which included a copy of tha receipted postcard from USPTO dated August 21, 2003. However, the postcard wasn’t from Arlene’s application but was from another application being handled by her firm.

Therefore, Arlene provided the USPTO with false or misleading information in connection with the petition to revive the abandoned patent application. Arlene’s application was dismissed on September 23, 2009.

A month later on November 25, 2009, Arlene filed a second petition to revive the patent application, relying on the same false receipted postcard from the prior application.

As a consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Board of Overseers punished Arlene by gifting her with a complimentary 2-month suspension of her law license.

As we speak (ca. June 2014) Arlene practices at 3 Winnecunnet Way in South Easton, Massachusetts.
