The state of
The Arizona State Bar found Dick guilty of engaging in the following misconduct.
Dick pled guilty to fraud, bribery and the disclosure of confidential information.
Dick admitted that he developed a scheme to defraud client who were making a claim under that National Childhood Vaccine Injury Act of 1986, by requiring these clients to agree to pay him a one-third contingency fee.
The Vaccine Act specifically provided that the U.S. Treasury would reimburse attorneys for reasonable fee and costs in handling such cases via submission to a Special Master at the U.S. Court of Claims.
Dick didn’t tell his clients that he was statutorily precluded form collecting a contingent fee from then and he further failed to inform the Special Master that he was taking a fee in addition to that awarded by the Special Master.
When Dick was being investigated by the Bar, he falsely stated t hat he had never charged a client with a contingent fee.
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Dick by ordering that he be disbarred.
Several years after they disbarred Dick, the comedians sitting on the Arizona Supreme Court voted to reinstate his law license.
