Chief Justice Thomas Moyer unlawfully backdates retired judge assignments

 

During Chief Justice Thomas Moyer’s re-election bid in 1998, I posed the following question to him, which is followed by his patently false response.
 
Q.        Do you think it is proper for the Chief Justice to backdate assignments for visiting judges?”
 
A.        “I do not back date the assignment of judges.”
 
The following undisputed facts, all of which were gleaned from a review of public records provided to me by the Ohio Supreme Court clearly prove that Chief Justice Thomas Moyer is a congenital liar. The most egregious example of Chief Justice Thomas Moyer’s illegal conduct is set forth in paragraph 3 below.
 
  1. On May 24, 1995, Judge Paul Moon of Ottawa County requested that Chief Justice Thomas Moyer assign Judge Richard McQuade for May, June and July, 1995, which Moyer received on May 30, 1995.
Between 5-30-95 and 6-2-95, Chief Justice Thomas Moyer approved and signed the assignment he received from Judge Paul Moon on May 24, 1995, which he then backdated to May 1, 1995, which was 23 days before he received the request. 
 
  1. On November 2, 1994, the Lucas County Common Pleas Court wrote a letter to the Supreme Court re: a phone conversation that morning for the assignment of Judge Richard McQuade, which was received by the Supreme Court by fax on the same date.
The Process Assignment Form proves the request was received on November 2, 1994. Moyer then approved/signed it and had an effective date of October 1, 1994 as an approval date. 
 
Therefore, Chief Justice Thomas Moyer “backdated” the assignment of Judge Richard McQuade
 
Between 11-2-94 and 11-14-94 (the date the assignment was mailed), Moyer approved/signed the assignment, which he then backdated to October 1, 1994 which was between 32 and 44 days before he received the request. (See Ex. C)
 
  1. On November 12, 1993, Judge Anne Maschari of Erie County requested the assignment of Judge Richard McQuade, which was received by Chief Justice Thomas Moyer on the same date. The following statements by Judge Anne Maschari to Chief Justice Thomas Moyer clearly indicates a willingness on her and Chief Justice Thomas Moyer’s willingness  to engage in the falsification of official court records:
"This Court's docket in the above captioned case does not reflect the appointment of Judge Bruce Huffman to this case; however, he did try the case all the way to verdict. I thought you would want to know this before appointing Judge Richard McQuade because it might make a difference in the way the Chief Justice wishes to word the entry(ies) to be drafted by your office in this particular case."
 
            11-15 handwritten note:
 
"Spoke to Nancy Coker. J. [Judge Bruce] Huffman has no record of assignment."
 
On November 23, 1993, Chief Justice Thomas Moyer signed the certificate of assignment, which was between 13 days after he received it." 
 
  1. On June 28, 1993, Judge Ruth Ann Franks of Lucas County (Toledo) requested the assignment of two judges for the month of June, 1993, which was received by Moyer on July 1, 1993. 
The top right corner of the request states: "Effective 6-1-93." 
 
Chief Justice Thomas Moyer then executed the assignment on July 7, 1993, with an effective date for the month of June 1993.
 
Conclusion
 
Can there be any doubt that Chief Justice Thomas Moyer is a congenital and habitual iar?
