Attorney Thomas Mullen of Quincy, MA; serial offender

 

The state of Massachusetts presented Thomas R. Mullen with a law license in 1977.

 

The Board of Bar Overseers found Tommy of the following misconduct.

 

Tommy’s 1st bite at the Attorney Misfit Apple Tree

 

Tommy found it acceptable to engage in deceptive (false and/misleading) advertisement in an effort to scam potential clients.

 

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Board of Overseers punished Tommy by gifting him with a complimentary admonition.

 

Tommy’s 2nd bite at the Attorney Misfit Apple Tree

  • Failed to promptly deposit client checks in client trust account
  • Failed to maintain complete trust account records
  • Failed to render accounts re: conservatorship estate
  • Failed to maintain records of receipt and disposition of funds received

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Overseers punished Tommy by gifting him with a complimentary reprimand.

 

Tommy’s 3rd bite at the Attorney Misfit Apple Tree

 

In one matter, Tommy agreed to create an estate plan for a 60-year-old woman who lived along, had no children, and suffered from medical conditions that began to affect her mental capacity.

 

The client had monthly pension income of $3,500, and about $774,000 in assets, including $485,000 in retirement funds, $45,000 in annuities, and $40,000 in mutual funds. She also owned a condominium.

 

Tommy convinced the client to convert her assets to Medicaid-compliant annuities sold by one of the insurance companies for which Tommy was an agent. Due to Tommy’s greed, she unnecessarily lost $5,000 when Tommy transferred her funds into four Medicaid compliant annuities. Tommy personally pocketed $42,000 in commissions for the transfer of his client’s funds.

 

As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Board of Overseers punished Tommy by gifting him with a complimentary 180-day suspension of his law license.

 

As we speak (ca. January 2014) Tommy practices with Mullen & Giarrusso, PC at 26 Chestnut Street in Quincy, Massachusetts.
