Attorney Philip Moran of Salem, MA; ethical dwarf

 

The state of Massachusetts presented Philip D. Moran with a law license in 1968 after he graduated from Suffolk University Law School.

 

The Board of Bar Overseers found Phil of the following misconduct.

 

In one matter a client hired Phil for estate planning purposes. Phil prepared a durable power of attorney and health care proxy form for the client. Thereafter, Phil prepared a will for the client.

 

About a year later, Phil represented the same client on an unrelated house matter. At the time, the client wished to revise his will, and he asked Phil to make several changes, including the addition of a $15,000 bequest to Phil.

 

The client and Phil were not related to each other. In preparing the will wherein Phil received a substantial bequest from someone he wasn’t related to was highly unethical.

 

About two years later, Phil borrowed $15,000 from the same client. Phil agreed to pay the loan in full; however, he didn’t prepare any instrument to show how the loan would be repaid and/or what interest would accrue. Phil never advised the client to seek outside counsel before agreeing to loan him $15,000.

 

Three years after the client lent Phil $15,000, he repaid the loan; however, he never paid any interest on the loan to the client (victim).

 

As one would suspect, this wasn’t Phil’s First bite at the Attorney Misfit Apple Tree. He previously received a complimentary admonition for engaging in a variety of misconduct.

 

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Board of Overseers punished Phil by gifting him with a complimentary 60-day suspension of his law license.

 

As we speak (ca. January 2014) Phil practices at 415 Lafayette Street in Salem, Massachusetts.
