Judge Edward Lee of Morgan Hill; CA; Dumbo The state of California provided Edward Fredrick Lee with a law license in 1983 after he graduated from Hastings Law School in San Francisco.
In 1995, former Gov. Pete Wilson was duped into appointing Raymond to a judgeship on the Santa Clara County Superior Court.
Ray didn’t receive the appointment because he was the most qualified attorney in the Santa Clara/San Jose area. He received the appointment because he had proven that he could be relied upon to act as a compliant lackey for the local political hacks.
In one matter, Judge Lee was assigned to preside over a case involving James Murphy who was charged with forcible oral copulation.
During Murphy’s trial, Judge Lee allowed the accuser to testify from behind a one-way mirror, so that she could not see Murphy.
The Santa Clara County Prosecutor, who requested the mirror, said the victim was afraid of Mr. Murphy. However, the Court of Appeals reversed Judge Lee in allowing for allowing the victim to conceal herself while testifying.
In fact, the appellate court cited the Sixth Amendment and a long line of U.S. Supreme Court decisions, in ruling that the use of the mirror violated Murphy’s constitutional right to confront his accuser. Put simply, the court of appeals threw out Murphy’s conviction.
How does one qualify to become a Judge if one does not understand a person’s constitutional right to “confront his/her accuser”?
Hopefully, the voters in Santa Clara County will send this Dumbo packing if he has the chutzpah to run for re-election in the future.
As we speak (ca. January 2014), Judge Lee continues to sit on the bench as a Santa Clara County Superior Court Judge in Morgan Hill, California, which is about 24 miles southeast of San Jose.
