Attorney Marc Schtul of Parker, CO; ethical goblin

 
The state of Colorado provided Marc Howard Schtul with a law license in 1992 after he graduated from the University of Denver Law School.
 
The Colorado State Bar found Marc guilty of the following misconduct.
  1. Engaged in conduct prejudicial to the administration of justice
  2. Failed to prosecute his client’s appeal
  3. Filed a frivolous claim
  4. Failed to provide competent representation (Dumbo)
  5. Failed to act with due diligence (slacker)
  6. Failed to communicate with clients
  7. Commingled client funds with personal funds
In one matter, after a large judgment was awarded against this client, Marc knowingly permitted his client to deposit over $120,000 into Marc’s attorney trust account, which resulted in the funds being hidden from the judgment creditor.
 
Subsequently, Marc’s firmed filed a Chapter 7 bankruptcy petition for the client. The client then revealed to opposing counsel revealed that his company funds had been deposited in Marc’s account, and that Marc signed checks from said funds to pay company wages and taxes and to distribute profits.
 
Marc’s conduct led the bankruptcy trustee to investigate the matter and to lodge fraudulent transfer charges against Marc, which were resolved in a confidential settlement.
 
Because Attorney Misfits in Colorado are held to a much lower standard of conduct then everyone else, Marc was never criminally charged for perpetrating a fraud on the bankruptcy court.
 
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Colorado Supreme Court punished Marc by gifting him with a complimentary 60-day suspension of his law license.
