Judge Leo Burns of Logansport, IN; Dumbo, loser

 
The state of Indiana presented Leo T. Burns with a law license in 1983 after he graduated from Valparaiso University Law School.
 
Leo succeeded in duping the voters into electing him as a Cass County Circuit Court Judge in 2006. Previously Leo spent 11 years at the public trough as Logansport city attorney.
 
Leo’s misconduct took place before he ascended to the bench and while he was a practicing attorney.
  • Failed to act with due diligence (slacker)
  • Failed to respond to client inquiries
  • Failed to provide competent representation (Dumbo)
  • Represented a client when limited by his own interest
In one matter, Leo represented Jason Burkett who was convicted of rape, criminal deviate conduct, sexual battery and two counts of criminal confinement. Burkett was sentenced to a total of 40 years. 
 
In an appeal, Leo again represented Burkett. The Court of Appeals upheld the trial court’s sentence, but because Leo failed to get a copy of the ruling to Burkett, the defendant missed a deadline for filing another appeal. Leo laughingly claimed that he promptly sent Burkett a copy of the Appellate opinion; however, the Supreme Court ruled that he offered no proof he had done so. As a result of Leo’s conduct, Burkett was prohibited from filing a subsequent appeal.
 
In another matter, Leo represented a man in a divorce proceeding. As part of the final divorce decree, Leo was supposed to prepare two Qualified Domestic Relations Orders (QDRO). Over the next 11 months, Leo failed to do so, and he failed to respond to numerous inquiries from his client and opposing counsel about the matter.
 
The QDROs that Leo eventually prepared were defective. As a result of Leo’s incompetence, the client (victim) was forced to complete the steps required for approval of one of the QDR)s.
 
As a consequence of his misconduct, the enablers for Judicial Misfits sitting on the Indiana Supreme Court punished Leo by gifting him with a complimentary reprimand.
 
As we speak (ca. October 2013), Leo continues to sit as a Cass County Circuit Court Judge in Logansport, Indiana.
