Attorney Heather Van Nuys of Seattle; serial perjurer, moron

From the early 1990s, Heather Van Nuys was unfortunately a sitting judge in Seattle.

In Washington, judges are required to submit an affidavit affirming they do not have any cases on their docket requiring a decision that has not been made in a timely fashion. They must do so every month in order to receive their paycheck, a fact well known to Judge Heather Van Nuys.

First Disciplinary Sanction

In May-June 1997, Judge Heather Van Nuys was the presiding judge in a civil case. She later issued a preliminary opinion letter regarding the case on Dec. 3, 1997. Judge Heather Van Nuys did not render the final opinion until April 22, 2002 (4 ½ years later), in violation of Washington law and the Code of Judicial Conduct.   Subsequently, Judge Heather Van Nuys received a complimentary admonishment from the commission for this misconduct.

Judge Heather Van Nuys agreed to enroll and attend a class on “judicial decision-making” at the Nat’l Judicial College in Reno, Nevada. Of course she attended while collecting her undeserved judicial salary. Who is the idiot that determined that a course in “judicial decision-making” would assist some lazy judge in learning how to comply with the law?

Second Disciplinary Sanction

At the same time Judge Heather Van Nuys agreed to the admonishment above, she was engaging in the same unlawful conduct as set forth above.

Judge Heather Van Nuys admitted that she delayed filing decisions in two civil cases (there were at least 12 more) covering the time period of time, Sept. 25, 1997 to April 29, 2002.

55 False Affidavits

During the period of delay (55 months), Judge Heather Van Nuys signed 55 individual affidavits falsely stating that no case assigned to her was more than ninety (90) days from readiness for decision without a decision having been made. These affidavits were titled “Affidavit for Payment of Salary of Superior Court Judge.”

The payroll staff for the county considered these affidavits as a prerequisite as payment for monthly judicial salaries. Pretty obvious why Judge Heather Van Nuys lied under oath 55 times, isn’t it? If she told the truth and nothing but the truth, she would have discovered what the term “pro bono” really means.

Judge Heather Van Nuys’ Laughable Perjury Defense

Judge Heather Van Nuys said that if required to testify at a hearing, she would have testified that, she when signed the affidavits (all 55 of them), she was affected by a psychological condition, and did not consciously consider that she was signing each affidavit in order to receive her monthly paycheck in a timely fashion.  Beam me up Scotty!

Judicial Commission Findings

The Judicial Commission said there were at least twelve (12) other cases of late decisions, and evidence that Heather filed false affidavits on a monthly basis in those cases.

Heather admitted that she filed approximately 55 false affidavits wherein she testified that she was in compliance with laws requiring prompt decisions when in fact, she was not. Since judges are held to a lower standard of conduct then we are, Judge Heather Van Nuys was never criminally charged for committing perjury.

As a result of her serial criminal violations, the Judicial Commission presented Judge Heather Van Nuys with a complimentary reprimand.

Attorney Heather Van Nuys Law Practice

Heather Van Nuys now practices law in the Seattle area. On her web site at www.vannuyslaw.com she has the chutzpah to proclaim that she’s “experienced, compassionate and concerned.” No mention on Heather’s web site that she is a congenital liar and was the subject of two disciplinary actions.

The U.S. District Court in Seattle finds it convenient to allow Heather Van Nuys to advertise on its website at http://www.wawd.uscourts.gov/CourtServices/mediators/VanNuys.htm.

As expected, the U.S. District Court makes no mention of the disciplinary actions taken against Heather Van Nuys by the Washington Judicial Commission.

If you’re looking to employ an attorney in the Seattle area, I would strongly urge you to avoid employing someone of Heather Van Nuys’ ilk. FYI: Heather, ilk is not a male ELK!
