Attorney Mitchell Landry of Lafayette, LA; ethical gremlin
The state of Louisiana presented Mitchell Reed Landry with a law license in 1996 after he graduated from Loyola University Law School located in New Orleans.
The Office of Disciplinary Counsel found Mitchell guilty of the following misconduct.
Mitchell was hired by attorney Ted Price and Authentic Title and assigned the responsibility of preparing the documents for closing the mortgage loan on Mr. Wallendorf's residence. While preparing the documents, Mr. Wallendorf told Mitchell that his wife, Patsy Wallendorf, had died a few months earlier after a long illness and disability. Mitchell advised Mr. Wallendorf that he would have to open the succession of his deceased spouse in order to complete the refinancing of the residence. Respondent offered to handle the succession.
Subsequently, Mitchell prepared and notarized an Affidavit of Death and Heirship that was executed by employees of Authentic Title when he knew or should have known that the employees did not have the necessary personal knowledge to execute the affidavit.
Two years later, Shirley Walker brought a lawsuit to annul the Judgment of Possession in Mr. Wallendorf’s favor. Shirley advised the court that Mrs. Wallendorf’s children were the proper heirs. Subsequently, the litigation was settled in Ms. Walker’s favor to the tune of $70,000.
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Louisiana Supreme Court punished Mitchell by gifting him with a complimentary reprimand.
As we speak (ca. July 2013) Mitchell practices at 1245 Camellia Blvd in Lafayette, Louisiana.
