Attorney John Nealon of Hopkinton, MA; lying loser
 
The state of Massachusetts presented John Anthony Nealon with a law license in 1983.
 
The Massachusetts Board of Bar Overseers found John guilty of the following misconduct.
  1. Failed to communicate basis or rate of fee to clients
  2. Failed to notify clients of receipt of settlement funds
  3. Knowingly lied to his clients
  4. Failed to promptly pay clients funds they were lawfully entitled to receive
  5. Failed to act with due diligence (slacker)
  6. Failed to provide competent representation (moron)
  7. Failed to maintain proper trust account records as required
  8. Failed to complete three-way reconciliation reports of trust accounts every 60 days as required
In one matter, John represented a husband and wife in regards to their efforts to purchase property from a builder, who also was to build them a house on the property. Later on the builder repudiated the contact to sell the property to the clients. John then advised the clients to file a lawsuit against the builder, which they agreed to do. However, Johnny never advised his clients of his hourly rate or provide them with a proposed written fee agreement.
 
Eventually the builder agreed to settle for $25,000. Johnny received a $25,000 check from the builder’s attorney along with a release to be signed by his clients. The attorney advised Johnny to hold the check in escrow until his receipt of an executed release.
 
Johnny then deposited the $25,000 into his trust account and immediately paid himself $15,000 as claimed fees. Johnny did not tell his clients of his receipt of the $25,000 or the $15,000 payment of fees.
 
Two months later, Johnny finally notified his clients by letter of his receipt of the $25,000 settlement check and sent them the release to be signed. In his letter, Johnny falsely said, “I have to hold the settlement check in escrow until I return the fully executed release.”
 
As one would suspect, this wasn’t John’s 1st bite at the Attorney Misfit Apple Tree. He previously received a complimentary admonition for engaging in a variety of misconduct.
 
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Bar Overseers punished John by gifting him with a complimentary 60-day suspension of his law license..
 
As we speak (ca. May 2013) John practices with Nealon & Nealon at 87 Elm Street in Hopkinton, Massachusetts.
