Attorney John Lynch of Bartow, FL; unethical Dumbo
The state of Florida presented John Stephen Lynch with a law license in 1979 after he graduated from the University of Florida Law School.
The Florida State Bar found John guilty of the following misconduct.
In one matter, Ewa Ozga hired John to file a motion for post-conviction relief on her behalf. After he filed the motion it was dismissed by the court for being facially insufficient. Thereafter, Johnny did not file a legally sufficient post-conviction motion prior to the sentencing becoming final in Ms. Ozga’s case.
Johnny the Dumbo advised Ms. Ozga that the filing of the first facially insufficient motion “stopped the clock running” on the time to file an amended motion, thereby suggesting that the filing deadline had not expired. As a result of the Dumbo’s gross incompetence, Ms. Ozga’s ability to file for post-conviction relief was lost.
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Florida Supreme Court punished John by gifting him with a complimentary reprimand.
As we speak (ca. May 2013) John continues to practice in the Bartow, Florida area.
