Attorney Daniel Marcus of Hartford, CT; ethical misfit 

 
The state of Connecticut provided Daniel Eric Marcus with a law license in 1985.
 
The Statewide Grievance Committee found Daniel guilty of the following misconduct.
  • Engaged in unethical conduct regarding immigration matter
  • Failed to exercise reasonable diligence
  • Failed to submit client tax documents to USCIS (INS)
  • Failed to safeguard client tax documents entrusted to him
  • Inconsistencies in client’s testimony re: $400 payment to client
In one matter, Daniel represented a client in connection with immigration matters. Subsequently, the client’s Application for Naturalization was denied for lack of good moral character for failure to file taxes timely and failure to address taxes owned to the IRS.
 
Daniel then filed a Request for a Hearing on a Decision in Naturalization Proceedings relative to the prior denial. The Immigration Service sent a notice to the client and Daniel in regards to a scheduled hearing on the request for a hearing. The client attended the hearing and was provided with a letter requesting the submission of additional tax information, necessary to complete the processing of his N-400 Application. A copy of the letter was sent to Daniel.
 
A month later, the client obtained a copy of certain Offers in Compromise tax documents from Attorney Sara V. Spodick of the Quinnipiac University Law School Low Income Taxpayer Clinic relevant to the Immigration Service requests. The Taxpayer Clinic assisted the client with regard to his tax issues. Shortly thereafter, the client went to Daniels office and delivered the tax documentation he received from the Taxpayer Clinic.
 
The Client paid Daniel $400 to forward the tax documents to the Immigration Service; however, Danny never submitted the documents. Shortly thereafter, the Immigration Service affirmed the prior decision denying the client’s N-400 application because of the failure to submit the requested tax information.
 
After the client received the denial of his N-400 application, he went to Daniels office to find out why he had not submitted the tax documentation. He then demanded that Daniel refund the $400 he paid for him to so act.
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Statewide Grievance Committee punished Daniel by gifting him with a complimentary reprimand.
 
As we speak (ca. May 2013) Daniel practices with Globman & Marcus at 44 Capitol Avenue in Hartford, Connecticut.
