Attorney Richard Krueger of Mendota Heights, MN; lying loser

The state of Wisconsin presented Richard J. Krueger with a law license in 1996 after he graduated from the University of Minnesota Law School.

The Office of Lawyer Registration (OLR) found Richard guilty of the following misconduct.

In one matter, Richard represented an 82-year-old client in a Chapter 7 bankruptcy action. At the time that Richard filed the bankruptcy petition for his client; the client owed Richard $7,384 in legal fees.

Contrary to bankruptcy law, Richard failed to list the $7,384 debt on the bankruptcy schedules he prepared for the client. Richard also failed to obtain the client’s written consent to a potential conflict of interest.

At the first meeting of creditors, the bankruptcy trustee asked Krueger's client if he had listed all of his debts, and the client responded that he had. Krueger was present and said nothing.

After the client was discharged in bankruptcy, Richard continued to represent him regarding three secured creditors who had filed adversary proceedings. While negotiating with creditors, Richard told them his client couldn’t pay more than 60% of his debt to them.

Richard received $40,000 from the client, deposited $28,000 to his client trust account to pay creditors, and applied the $12,000 balance to the client’s current and past legal fees, including the $7,384 that should have been listed in the bankruptcy matter.

When Richard was interviewed by OLR investigators, he initially misrepresented (lied) that the amount the client owed him was less than $500 at the time of the bankruptcy and that he had never been paid that amount.

As a consequence of her misconduct, the enablers for Attorney Misfits sitting on the Wisconsin Supreme
Court punished Richard by gifting him with a complimentary 60-day suspension of his law license.

As we speak (ca. May 2013) Richard practices at 1266 Birch Court in Mendota Heights, Minnesota.
