Attorney John Giglio of Ringgold, GA; ethical elf

The state of Tennessee presented John Michael Giglio with a law license in 2006 after he graduated from Georgia State University Law School. Philip also received a law license from the State of Georgia in 1995.

The Tennessee Board of Professional Responsibility found John guilty of the following misconduct.

In an estate matter, John told his client he would charge him a 15% contingent fee, but he failed to provide a written fee agreement to the client.

Because John wasn’t licensed in Tennessee, John divided his fee with a licensed Tennessee attorney.

Subsequently, the client contested the reasonableness of John’s $70,000 attorney fee with the Probate Court because John charged 15% of the $500,000 that the client received from an insurance company without the assistance of John.

The Probate Court later ruled that a reasonable fee for John’s services was $20,000, and ordered him to refund $50,000 to the client plus pay the costs of the fee hearing.

As a consequence of her misconduct, the enablers for Attorney Misfits sitting on the Tennessee Supreme
Court punished John by gifting him with a complimentary censure.

As we speak (ca. March 2013) John practices at 7713 Nashville Street in Ringgold, Georgia.
