Attorney Janet Spence of Pembroke Pines, FL; ethical misfit

 
The state of Florida presented Janet Elaine Spence with a law license in 1996.
 
The Florida Bar found Janet guilty of the following misconduct.
  • Commingled client funds with her personal funds
  • Failed to maintain client funds in separate client trust account
  • Failed to maintain deposit slips for trust accounts
In one matter, Janet represented Kathleen and Derrick Rodney in a real estate closing matter. Ms. Rodney and her son Derrick were selling property located in Miami, Florida. At the time she was hired, Mr. Rodney had an outstanding judgment against him for $9,742 with interest accruing at 11% a year. The judgment constituted a lien on the Miami property.
 
With the permission of the Rodneys’, Janet withheld $15,000 from the Rodneys’ closing proceeds in order to pay off the lien and clear title to the property.
 
Subsequently, the creditor was paid in full; however, Janet failed to return $757 left in the client trust account to the Rodney’s, and didn’t do so until the State Bar ordered her to so act.
 
As a consequence of her misconduct, the apologists for Attorney Misfits sitting on the Florida Supreme Court punished Janet by gifting her with a complimentary reprimand.
 
As we speak (ca. March 2013) Janet continues to practices with J.E. Spence, PA in Pembroke Pines, Florida area.
