Attorney Scott Schlievert of Tucson; repeat offender

 
The state of Arizona presented Scott W. Schlievert with a law license in 1972 after he graduated from the University of Arizona Law School.
 
The Arizona State Bar found Scott guilty of misconduct on at least two separate occasions as set forth below.
 
Scott’s 1st bite at the Attorney Misfit Apple Tree

  1. Failed to consult with client regarding legal matter
  2. Failed to act with due diligence (slacker)
  3. Failed to communicate with client
  4. Failed to safeguard client property
  5. Failed to take necessary steps to protect client’s interests after being discharged
As a consequence of his misconduct, the cheerleaders of Attorney Misfits sitting on the Arizona Supreme Court punished Scott gifting him with a complimentary censure.
 
Scott’s 2nd bite at the Attorney Misfit Apple Tree

  1. Failed to consult with client regarding legal matter
  2. Failed to act with due diligence (slacker)
  3. Failed to consult with client regarding legal matter
  4. Failed to take necessary steps to protect client’s interests after being discharged
  5. Engaged in conduct prejudicial to the administration of justice
  6. Engaged in a pattern of misconduct
  7. Misconduct involved multiple offenses
  8. Failed to timely refund unearned fees
  9. Failed to properly withdraw from case when withdrawal was mandatory
In one matter involving a child custody case, Scott failed to return client phone calls and failed to provide requested monthly billing statements even though his fee agreement called for monthly statements. After being fired, Scott failed to promptly return client file to the new attorney, resulting in the attorney filing a motion to continue a custody hearing.
 
In another matter, Scott failed to appear for a domestic settlement conference. He then failed to file a court-ordered affidavit addressing his failure to appear at the settlement conference. The court then ordered a show cause (contempt) hearing, which Scott failed to appear.

 

In another domestic relations matter, Scott failed to communicate the limitations as to the scope of his representation to his client. As a result, the client did not respond or appear for various events in the matters, as he reasonably believed that Scott would appear on his behalf.

 

As a consequence of his misconduct, the cheerleaders of Attorney Misfits sitting on the Arizona Supreme Court punished Scott gifting him with a complimentary censure.
