The state of Wisconsin presented Michele Anne Tjader with a law license in 1996 after she graduated from Marquette University Law School.
The Office of Lawyer Registration (OLR) found Michelle guilty of the following misconduct.
In one matter, Michele was hired to represent a client that was seeking a transfer to a minimum-security prison and/or to help him obtain parole. The client had completed a Department of Corrections program that led to automatic eligibility for transfer to minimum security and/or parole board review, but when completed by the client, no longer led to such automatic relief. Because the client was in prison, most of the communications regarding his representation was between his fiancée and Michele.
At the beginning of the representation, the client was told by the client that he sought a quick resolution of the matter. Michele told his fiancée that a habeas corpus petition was the proper procedure to purse; however, she told the fiancée that had previously only filed one habeas petition, and had never handled a cause such as the client’s.
Despite her admitted incompetence, Michele never did any legal research nor did she consult with other attorneys about the proper procedure in such a matter. At no point did Michelle consider or research the possibility of filing a petition for writ of certiorari (appeal to higher court), or alternative procedural mechanism for accomplishing the client’s objective.
As a consequence of her misconduct, the Wisconsin Supreme Court punished Michelle by gifting her with a complimentary reprimand.
As we speak (ca. March 2013) Michelle practices with Tjader Law Inc at 7 North Pinckney Street in Madison, Wisconsin.
