Attorney Paul McCarthy of North Andover, MA; ethical gnome

 

The Massachusetts Supreme Court presented Paul D. McCarthy with a law license in 1999.

 

The Board of Bar Overseers found Paul guilty of the following misconduct.

  1. Engaged in a blatant conflict of interest
  2. Ignorant as to his ethical obligations
  3. Failed to provide competent representation (moron)
  4. Failed to advise clients they could bring lawsuit against home seller for breach of contract
  5. Failed to explain matter to extent to permit client to make informed decisions
  6. Failed to act with due diligence (slacker)
  7. Ignorant of relevant real estate law

In one matter, Judy Mund and Robert Brennan (John’s clients) were prospective homebuyers who first met Paul at a first-time homebuyer seminar presented by H&R Block Mortgage Corp. Paul was serving as the moderator at the seminary, and was introduced as an attorney experienced in real estate matters who represented H&R Block at closings. At the seminary, John failed to explain any potential conflicts of interest that would occur between buyers, attorneys for lenders like himself, real estate agents, and lenders like H&R Block.

 

John’s clients (Mund and Brennan) later contacted Buyer’s Choice Realty and engaged a buyer’s broker, Tacheryn McCarthy, who just happened to be Johnny’s wife. Tacheryn emphasized to her clients the need for legal representation in real estate transactions, and, indicated that they could hire her husband Johnny as their attorney. The couple then hired Johnny to act as their attorney.

 

Based on his wife’s advice, the couple hired Johnny to represent them in the real estate deal. However, Johnny never advised the couple about the obvious conflict of interest that he was clearly involved in.

 

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Board of Overseers punished Paul by gifting him with a complimentary 90-day suspension of his law license. 

 

As we speak (March 2013) Paul practices with McCarthy and Molloy at 65 A Flagship Drive in North Andover, Massachusetts.
