Attorney Thomas Bayard of Diamond Bar, CA; thief, repeat offender

 
The state of California provided Thomas James Bayard with a law license in 2003 after he graduated from the University of LaVerne Law School.
 
The California Bar Court found Thomas guilty of misconduct on two separate occasions as set forth below.
 
Thomas’ 1st bite at the Attorney Misfit Apple Tree 

  1. Failed to perform legal services competently (moron)
  2. Failed to respond to client status inquires
  3. Failed to refund unearned fees (thief)
  4. Failed to return client files to client after being discharged
  5. Failed to cooperate with bar’s investigation (Up Yours, said Tommy!)
In one matter, Thomas added a woman as a plaintiff in a civil lawsuit without her consent. Despite her demand that he remove her name from the case, it took Tom the Loser eight months to do so. Kind of a novel way to drum up new clients!
 
In another matter, a client hired Thomas to appeal her denial for disability benefits. Thomas sued the Social Security Administration but his petition was dismissed because he failed to file a proof of service or a joint stipulation that was ordered by the court. Thomas did not tell the client her case was dismissed for more than two (2) years, when he finally admitted he failed to file documents on time.
 
Thomas then agreed to pay the client (victim) $45,000 at $2,500 a month in order to resolve any possible malpractice claims.
 
As a consequence of his misconduct, the enablers for Judicial Misfits sitting on the California Bar Court punished Thomas by gifting him with a complimentary 60-day suspension of his law license.
 
Thomas’ 2nd bite at the Attorney Misfit Apple Tree 

  1. Failed to account for client funds
  2. Failed to provide competent representation (moron)
  3. Failed to act with due diligence (slacker)
  4. Failed to keep client informed of status of her case
  5. Failed to refund unearned fee (crook)
  6. Failed to cooperate with bar investigators (Up Yours, said Tommy!)
  7. Failed to communicate with client
In one matter, Thomas represented a client in an ongoing dispute over a construction loan. The client paid Thomas an upfront fee of $8,400. Thomas missed several court ordered appearances. As a result of his failure to appear at the hearings, the court dismissed his client’s complaint. Thomas did not inform the client of the dismissal of her case. Thomas then refused to return unearned fees to the client.
 
In another matter, Thomas filed a Chapter 7 bankruptcy petition for a client but it was summarily rejected when the court listed nine (9) deficiencies in the petition. Thomas then asked the client for an additional $299 to refile the petition, and although she gave him the money, he never refiled it and the court closed the client’s case. Subsequently the client sued won a small claims award of $3,218 against Thomas.
 
As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the California Bar Court punished Thomas by gifting him with another (2nd) complimentary 60-day suspension of his law license.
 
As we speak (ca. February 2013), Thomas practices with Alessi & Bayard at 556 North Diamond Bar Blvd in Diamond Bar, California, which is located in Los Angeles County.
