Attorney Bryan Smith of Topeka; serial drunk

 
The state of Kansas presented Bryan W. Smith with a law license in 1992.
 
The Kansas Disciplinary Board found Bryan guilty of the following misconduct.
  1. Engaged in conduct adversely reflecting on fitness to practice law
  2. Engaged in criminal conduct
  3. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  4. Engaged in a pattern of misconduct
For years, Bryan practices law with attorney Stephen Cavanaugh and attorney Thomas Lemon in Topeka. Bryan claims that at some point after becoming an attorney he developed a serious alcohol problem. One day over lunch, Bryan became intoxicated causing his partner to drive him home.
 
At the behest of his partners, he entered into a 28-day impatient treatment program at Valley Hope. When he returned to work, he was required to enter into a contract which greatly limited his ownership interest in the firm if he continued to drink. After his release and execution of the contract with his partners, Bryan the Drunk continued to booze it up.
While driving from Topeka to the Kansas City airport (70 miles), Bryan downed a fifth of Vodka. He then boarded a plane to Memphis, Tennessee.
 
During the flight, Bryan downed even more booze. He was quite disruptive on the plane and was met by security when he deplaned. At that time, Bryan was arrested for public intoxication and disorderly conduct. While en route to the police station, Bryan damaged a police car window and was then charged with felony vandalism.
 
As a result of his arrest, his law firm, Cavanaugh, Smith & Lemon,, P.A. terminated Bryan’s employment. Despite the arrest and firing, Bryan continued to booze it up.
 
Bryan then returned to Valley Hope for detoxification. He then participated in an inpatient program in Oklahoma; however, he continued to booze it up.
 
Subsequently, Bryan entered the Attorney Diversion Program with the Disciplinary Administrator’s Office. He then agreed to comply with treatment recommendations and to abstain from consuming any alcoholic beverages. As suspected, Bryan’s promise wasn’t worth anything since he continued to get plastered.
 
Two years later, Bryan had the chutzpah to tell the Disciplinary Board that he stopped drinking. As expected the morons on the board actually believed him!
 
As a consequence of her misconduct, the Cheerleaders for Attorney Misfits sitting on the Kansas Supreme Court punished Bryan by gifting him with a complimentary censure.
 
As we speak (ca. February 2013) Bryan practices at 5930 Southwest 29th Street in Topeka, Kansas.
