Attorney Peter Malaguti of Andover, MA; ethical elf
The Massachusetts Supreme Court presented Peter with a law license in 1981 after he graduated from the Massachusetts Law School.
The Board of Bar Overseers found Peter guilty of the following misconduct.
Over a four year period of time, Peter was “of counsel” to The Crest Group, LLC. The principal of the law firm was Peter Unitt. Peter handled closing for The Crest Group and was designated as closing attorney.
During this period of time, Peter sometimes signed the closing documents either before or after the closing instead of at the closing. On several occasions he signed the documents outside the closing, and did not attend the closings.
In one matter, the borrower singed the closing documents for two loans. Neither Peter nor any other attorney from The Crest Group was present when the lady signed the closing documents, and the borrower received no explanation of the documents either before or at the closing. Peter failed to inform the lender that he wouldn’t be present and the closing and did not obtain the lender’s consent to so act.
In another matter, a borrower signed two sets of closing documents for two separate home equity loans. In each case, the borrower signed the documents at her home in the presence of a non-lawyer employee of The Crest Group. In both cases, Peter did not inform the lender that he had not attended the closing, and, in both cases, he signed all the closing documents as closing attorney.
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Board of Overseers punished Peter by gifting him with a complimentary reprimand.
As we speak (January 2013) Peter practices at 500 Federal Street in Andover, Massachusetts.
