Attorney Jack Phillips of New York City; ethical leper-con

The state of Florida provided Jack Barry Phillips with a law license in 1999 after he graduated from St. Thomas University Law School.

The Florida State Bar found Richard guilty of the following misconduct.
  1. Failed to provide competent representation (moron)
  2. Failed to communicate with clients
  3. Failed to keep clients informed about status of legal matters
  4. Failed to return unearned fees to clients
  5. Failed to act with due diligence (slacker)
  6. Failed to accept responsibility for his gross negligence
  7. Failed to comply with client’s requests for information
  8. Failed to sufficiently explain matters to client to allow client to make informed decision re: representation
  9. Moved law office without notifying the State Bar as required
  10. Failed to respond to State Bar inquires (Up Yours, said Jack)
  11. Knowingly failed to perform services on client’s behalf
  12. Engaged in a pattern of neglect of client matters
  13. Engaged in bad faith obstruction of the disciplinary process
  14. Exhibited indifference in making monetary restitution to client
  15. Refused to acknowledge wrongful nature of his conduct
In one matter, Jack was hired by Jose Nicolas Castillo to represent him in immigration court proceedings. Castillo had previously been denied political asylum and was the subject of removal proceedings. During the removal proceedings, testimony established that Castillo married an American citizen and sought to gain lawful permanent residence with an application for change of status. Since Castillo was already in removal proceedings, the INS had exclusive jurisdiction to hear the adjustment application.

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Florida Supreme Court punished Jack by gifting him with a complimentary 3-year suspension of his law license.

As we speak (ca. January 2013) Jack practices at 244 5th Avenue in New York, New York.
